1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of Video-Generate website, products, and AI video generation services (collectively, the "Services"). By using the Services, you agree to these Terms.

2. Eligibility and Accounts

  • You must be legally capable of entering into a binding agreement.
  • You are responsible for your account credentials and all activity under your account.
  • You must provide accurate billing and contact information.
  • You may not use the Services if suspended or prohibited by law.

3. Service Description

Video-Generate provides AI-assisted tools to create video outputs from prompts, images, and other user inputs. Features may change over time and may depend on third-party providers.

4. Subscriptions, Credits, and Billing

  • We offer recurring subscriptions and one-time credit purchases.
  • Subscriptions renew automatically at the end of each billing cycle unless canceled before renewal.
  • Credits are consumed when generation requests are processed. Credit amounts and expiration periods are described on the pricing and checkout pages.
  • Prices, taxes, and plan terms shown at checkout govern your purchase.
  • Unless otherwise stated at checkout, charges are processed in U.S. Dollars (USD).
  • We may update pricing prospectively. Changes do not apply retroactively to completed billing periods.
  • After successful payment confirmation, digital credits are typically added to your account immediately. In some cases, delivery may be delayed by risk review, technical incidents, or payment-provider processing delays.

5. Cancellation and Refund Policy

  • Subscription cancellation: You may cancel any time. Cancellation takes effect at the end of the current paid period unless otherwise required by law.
  • One-time purchases: In general, one-time digital credit purchases are non-refundable once credits are used.
  • Refund requests: You may request review within 7 days of purchase by emailing [email protected]. We may issue a full or partial refund when required by law or in cases such as duplicate billing, unauthorized payment, or verified technical failure.
  • Chargebacks or payment disputes may result in temporary account restrictions while the matter is reviewed.

6. Acceptable Use and Content Restrictions

You must comply with our Safe Use Policy. You may not use the Services for illegal, harmful, infringing, deceptive, or abusive purposes, including generating prohibited content or violating third-party rights.

7. User Content and Generated Output

  • You retain rights to content you submit, subject to rights necessary for us to operate the Services.
  • You grant us and our subprocessors a worldwide, non-exclusive license to host, process, reproduce, and transmit your content solely to provide, secure, and improve the Services.
  • AI outputs may not be unique and may contain inaccuracies. You are responsible for reviewing outputs before use or publication.

8. Intellectual Property and Copyright Complaints

The Services, including software, branding, and site content (excluding user content), are owned by Video-Generate or its licensors. If you believe content infringes your copyright, contact [email protected] with sufficient detail for review.

9. Suspension and Termination

We may suspend or terminate access if we reasonably believe you violated these Terms, the Safe Use Policy, applicable law, or payment-provider requirements, or if your use poses security, fraud, or abuse risks.

10. Disclaimers

The Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose, non-infringement, and uninterrupted availability.

11. Limitation of Liability

To the maximum extent permitted by law, Video-Generate and its affiliates, officers, employees, and partners will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, revenue, data, or goodwill arising from use of the Services. Aggregate liability will not exceed the amount you paid to us in the 12 months preceding the event giving rise to the claim.

12. Indemnification

You agree to defend, indemnify, and hold harmless Video-Generate from claims, liabilities, damages, and expenses arising from your use of the Services, your content, or violation of these Terms.

13. Changes to Terms

We may update these Terms from time to time. Continued use of the Services after an update becomes effective constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by applicable laws of the jurisdiction where the service operator is established, without regard to conflict-of-laws rules, except where mandatory consumer protection laws require otherwise.
